Terms and conditions of online Sales
These conditions govern purchases made on the website www.lerosedipupa.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Italian Consumer Code, D.lgs. n. 206/2005, modified by D.lgs. n. 21/2014 and by D.lgs. 70/2003 in the field of electronic commerce.They are valid exclusively for the company "Le Rosei Pupa" based in - Casa Paolina 88 - 15071 Carpeneto - (AL), Vat N°: 02362020063, hereinafter referred to as "VENDOR" and any person who makes online purchases on the website www.lerosedipupa.it hereinafter referred to as ' 'CUSTOMER ' '. These conditions may be amended and the date of their publication on the site is equivalent to the date of entry into force.
Article 1: Contract Object
With these General Terms and Conditions of Sale, VENDOR sells and the CUSTOMER purchases at a distance the tangible movable assets indicated and offered for sale on the website www.lerosedipupa.it. The contract is concluded exclusively through the internet, through the access of the CUSTOMER to the address www.lerosedipupa.it and the realization of a purchase order according to the procedure provided by the site itself.
The customer undertakes to review, before proceeding with the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by VENDOR and to accept it by means of a flag in the box indicated.
In the order confirmation email, the CUSTOMER will also receive the link to download and store a copy of these general conditions sale, as provided for by art. 51 paragraph 1 of italian Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
Article 2: CONSUMER PRE-CONTRACTUAL INFORMATION
The CUSTOMER before the conclusion of the purchase contract, takes a look at the characteristics of the goods that are illustrated in the individual product sheets at the time of selection by the CUSTOMER.
Prior to the validation of the order with "payment obligation", the CUSTOMER is informed about:
- total price of goods including taxes, with details of shipping costs and any other costs;
- terms of payment;
- the period within which VENDOR undertakes to deliver the goods;
- conditions, terms and procedures for exercising the right of withdrawal (see art. 7 of these conditions) as well as the model form of withdrawal referred to in Annex I, Part B of Legislative Decree 21/2014;
- information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal
- existence of the legal guarantee of conformity for the purchased goods; - conditions of after-sales assistance and commercial guarantees provided by VENDOR.
The CUSTOMER may at any time and in any case before the conclusion of the contract, take note of the information of the VENDOR, (geographical address and e-mail address) this information is reported, also hereafter I infuse to any page of the site.
Article 3: Contract conclusion and effectiveness
The sales contract is considered concluded with the sending by the VENDOR to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER’s data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to print and store the copy of these conditions.
The CUSTOMER undertakes to verify the correctness of the personal data contained in the aforementioned email and to promptly inform VENDOR of any corrections/changes to be made.
VENDOR undertakes to describe and present the items sold on the website in the best possible way. Nevertheless, there may be some errors, inaccuracies or small differences between the product depicted on the site and the actual product. In addition, the photographs of the products presented on www.lerosedipupa.it are not contractual elements, as they are only representative.
VENDOR undertakes to deliver the goods within 60 days from the sending by VENDOR of the order confirmation e-mail to the CUSTOMER.
Article 4: Products avaiability
The availability of the products refers to the actual availability at the time the CUSTOMER places the order. This availability should in any case be considered purely indicative as:
- the products could in the meantime be sold to high CUSTOMERS before the order confirmation, due to the simultaneous presence of multiple users on the site,
- there may be computer errors such as to make a product available for purchase which is not actually available for purchase.
Even following the sending of the order confirmation email sent by VENDOR, there may be cases of unavailability of the goods, both partial and total. In the case of this eventuality, the order will be rectified automatically with the elimination of the product or products not available and the CUSTOMER will be immediately informed via and-mail; with this e-mail the customer will also be informed of the methods and timing of reimbursement of any sums paid.
Article 5: Payment methods
Any payment by the CUSTOMER may be made only by Paypal payment method.
In case of payment by credit card, the actual charge of the order amount will be made only when the order will be complete and ready for shipment.
In case of payment by Paypal, the actual charge will be made when the order confirmation email is sent by the VENDOR.
The communications relating to the payment and the data communicated by the CUSTOMER at the time this is carried out are made on special lines protected through the Paypal platform.
Article 6: Prices
All sales prices of the products listed on the website www.lerosedipupa.it are expressed in Euro and include VAT, and where applicable, the WEEE contribution.
The shipping costs are not included in the purchase price, but are indicated and calculated at the time of the conclusion of the purchase process before the payment.
The CUSTOMER accepts the option of VENDOR to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of confirmation of the order and repeated in the confirmation e-mail sent by VENDOR to CUSTOMER.
In the case of computer errors, handbooks or any other nature which may result in a substantial change, not foreseen by VENDOR, of the selling price to the public, which renders it exorbitant or clearly irrelevant, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days. from the day of the annulment.
Article 7: Right to withdraw
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.
VENDOR decides to extend this term from 14 to 30 days. It will therefore be possible for the CUSTOMER to withdraw from the purchase contract up to 30 days. after the day of receipt of the products purchased online. In case of multiple purchases made by the CUSTOMER with a single order and delivered separately, the period of 30 days. start from the date of receipt of the last product.
The CUSTOMER in case he intends to exercise the right of withdrawal will be obliged to communicate to the VENDOR his will through explicit declaration , which must be transmitted by registered mail a.r. or to the pec address:
The CUSTOMER is obliged to return the goods to the VENDOR within 14 days from the date of withdrawal, sending the products to the following addresses: Casa Paolina 88 - 15071 Carpeneto - (AL).
Article 8: Legal guarantee of conformity
In case of receipt of defective products or in any case not in compliance with the orders placed, the CUSTOMER has the right to return the products free of charge and to restore their conformity by repair or replacement. The CUSTOMER can exercise this right if the defect occurs within one year from the delivery of the goods and report the defect to VENDOR within one month from the vision of it. In order to exercise the right above, the customer must proceed to the creation of a computer practice of Return by email to the address Pupinadisalvo@gmail.com; the VENDOR , ascertained the case of defective or non-compliant product, will provide, at its own expense, to organize the collection of the product, compatible with the availability of the CUSTOMER.
Article 9: Delivery method
VENDOR will only accept orders to be delivered in Italy and the Republic of San Marino. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order no later than 30 days. from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by VENDOR.
For each order placed on the website www.lerosedipupa.it, VENDOR issues invoice of the goods shipped. The invoice will be sent to the email provided by the customer within 30 days. from the processing of the order. The invoice will contain the information provided by the CUSTOMER during the purchase process. After the invoice is issued, it will not be possible to make any changes to the data indicated in the invoice.
Article 10: Responsible
VENDOR assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in the event that it fails to execute the order within the time provided by the contract.
Article 11: Access to website
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, in particular commercial, of the site or its content is allowed. The integrity of the elements of this site are the property of VENDOR .
Article 12: Cookies
The website www.lerosedipupa.it uses ' 'cookies ' '. Cookies are electronic files that record information related to the navigation of the CUSTOMER on the site (pages consulted, date and time of consultation, etc.) and that allow VENDOR to offer a personalized service to its customers.
